ACCEPTANCE OF TERMS

This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures. Please read these T&Cs (defined below) along with the PikniPlanet Terms of Use and Privacy Policy (collectively referred to as “Agreement”) carefully before procuring / availing any Offerings (defined below).

www.funactions.in (Website, Mobile-website & progressive webapp) is an online based booking service provider for different learning, play, fitness and entertainment activities fully owned and operated by PIKNIPLANET PRIVATE LIMITED (“PikniPlanet”), a company registered and incorporated under the laws of India, with its head office located at 1st floor, MRAster Complex, Whitefield, Bangalore 560066.

Through the funactions website, PikniPlanet shall provide users/customers information related to slot availability, booking/reserving, and pricing for the above-mentioned activities throughout India. The services more particularly described in the Terms of Service("ToS"). This User Agreement ("Agreement") sets out the terms and conditions on which PikniPlanet shall provide the services to the User through the Website or App. User shall be required to read and accept the relevant ToS for such service, which may be modified or updated by PikniPlanet from time to time.

Use of funactions website is offered to the users/customers upon the conditioned-on acceptance without modification of all the terms, notices and conditions contained in this Agreement. The User hereby consents that the user has read and comprehends PikniPlanet’s privacy policy with regard to the Website/App, and that the user is in agreement with the terms and contents of that privacy policy.

ACCOUNT REGISTRATION

User(You) need to register on our Website to avail our Services by verifying either your mobile number or email address and providing your name and other personally identifiable information. To protect your funactions account, keep your login credentials viz., password and OTP confidential. You are solely responsible for all the activity that happens on or through your Funactions account, whether authorized by you or not. By registering, you hereby grant consent for contacting you via telephone or email based on the information furnished by you either by us, or our Affiliates or third parties nominated in this regard for providing better services or for promotional activities related to the Services.

By using the Website and/or registering yourself at www.funactions.in you authorize us to contact you via email or phone call or SMS and offer you our services, imparting product knowledge, offer promotional offers running on website & offers offered by the associated third parties, for which reasons, personally identifiable information may be collected. And irrespective of the fact if you have also registered yourself under DND or DNC or NCPR service, you still authorize us to give you a call from funactions for the above-mentioned purposes till 365 days of your registration with us.

You agree that the basic customer information, personal identifiable information provided by you is true, complete and accurate, and agree not to submit any particulars which are false or any information you do not have any right or authority to provide. You are solely responsible for maintaining the confidentiality and security of all activities that occur on or through your access of the Website.

USER LIMITATIONS

The User agrees and undertakes not to sell, trade or resell or exploit for any commercial purposes, any portion of the Service. However, the user can cancel the service which was reserved/booked within stipulated time with cancellation charges. The user agrees not to use any loophole or bug in the system to gain benefits in booking.

The User further agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Website.

User must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. User must not attempt to gain unauthorized access to our site, the server on which our site is stored or any server, computer or database connected to our site. User must not attack our site via a denial-of-service attack or a distributed denial-of-service attack.

You(user) may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

REFUNDS AND CANCELLATIONS

If you are no longer able to bring your kid to soft play zone you can request a refund, in this scenario your refund would be credited to original payment or funactions wallet.

SAFETY AND ENJOYMENT

Breach of any of the rules and regulations of the Venue, being underage or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the Venue to refuse admission or require you to leave the Venue.

The softplay zone is a completely smoke free environment throughout. Any customer found to be smoking within the premises, will be ejected immediately without any entitlement to a refund. This applies to e-cigarettes and vaping.

No illegal substances may be brought onto or consumed on the premises. Any customer found to be, or suspected to be, in possession of such substances will be ejected from the premises and may be reported to the police without any entitlement to a refund.

Customers are hereby notified that CCTV monitoring of the inside and the outside of the premises may take place for the purpose of protecting guests, staff and property.

DATA PROTECTION

Pikniplanet may use your personal information together with other information for providing services marketing administration and training. We may also keep your information for a reasonable period in order to contact you about our services. Although you may decide by giving us notice in writing at any time that you no longer wish to receive marketing materials. By accepting these terms, you are giving your consent to these activities.

ELECTRONIC TICKET DELIVERY

All booking slots (Tickets) will be electronic tickets or Booking ID and will be sent by email or to registered phone number. You will need to present your Ticket to gain access to the venue.

DISCLAIMER OF WARRANTIES AND LIABILITY

Pikniplanet has endeavored to ensure that all the information on the website is correct, but Pikniplanet neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information contained. Pikniplanet makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of the information contained in the website.

Since Pikniplanet acts only as a booking mediator, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Pikniplanet be liable for the services provided by the service provider.

Although Pikniplanet makes reasonable commercial efforts to ensure that the description and content in the ToS and on each page of the website is correct, it does not, however, take responsibility for changes that occurred due to human or data entry errors or for any loss or damages suffered by any user due to any information contained herein. Also, Pikniplanet is not the service provider and cannot therefore control or prevent changes in the published descriptions which are based upon information provided by the service providers.

Pikniplanet does not endorse any advertiser on its website in any manner. The users are requested to verify the accuracy of all information on their own before undertaking any reliance on such information.

ACCESS CONTROL

PikniPlanet reserves the right, in its sole discretion, to terminate the access to the website and the related services or any portion thereof at any time, without notice.

INTELLECTUAL PROPERTY

The Platform and the processes, and their selection and arrangement, including but not limited to, all text, videos, graphics, user interfaces, images, photos, visual interfaces, sounds and music (if any), artwork and computer code (and any combinations thereof) (collectively, the “Content”) on the Platform is owned and controlled by the Platform operator, Seller(s) and / or their licensors and the design, structure, selection, coordination, expression, look and feel and arrangement of such Content is protected by copyright, patent and trademark laws, and various other intellectual property rights.

The trademarks, logos and service marks displayed on the Platform (“Marks”) are the property of the Platform operator, Seller(s) and / or their vendors and / or other respective third parties, as the case may be. Users are not permitted to use the Marks without the prior written consent of the relevant party, or the vendors, or the third party that may own the Marks.

Users will not use any trade mark, service mark, trade name, or logo of any company or organization in a way that is likely or intended to cause confusion about the owner or authorized user of such marks, names or logos.

CONFIDENTIALITY

User must keep any information obtained relating to PikniPlanet Platform confidential and will not use such information for any purpose that is not specifically provided for in this Agreement or authorized by us in writing.

ACCEPTANCE

Please click on the button marked "I Accept" at the end of these terms and conditions if you accept them. If you refuse to accept these terms and conditions, you will not be able to order any Tickets from our site.

TERMS AND CONDITIONS - FOR PARTNERS

ACCEPTANCE OF TERMS

PIKNIPLANET PLATFORM

PikniPlanet’s proprietary online website and/or mobile based booking application.

SOFTPLAY ZONE/CENTER

Playzone/ Softplay Zones is an entertainment or active learning place where kids from age 2 to 15 can book through Pikniplanet Pvt Ltd website Funactions.in and use the center accompanying with parents or guardians for certain amount of time.

SOFTPLAY ZONE PARTNER

The entity/individual being the legal owner of the softplay zone as mentioned in the Form for providing the Services at the play center.

DIGITAL FORM

Duly signed Playzone Partner Enrolment Form executed by the Playzone Partner for providing services through PikniPlanet Pvt Ltd.

SOFTPLAY ZONE STAFF

The employees, representatives, managers, agents, sub-contractor/vendor, personnel, staff, drivers, or anyone else working under the instructions of the Softplay Zone Partner at the center.

PLAYZONE PARTNER OBLIGATIONS

Playzone Partner shall ensure to procure all relevant licenses from state and central government to operate the center. Pikniplanet reserves the right to cancel or withhold the partnership of the playzone Partner in lieu of the non-compliance of such rules and regulations.

Playzone Partner shall be solely responsible for any loss, damage, or injury caused to User/customer/guest for any reason that is attributable to the Playzone Partner or the Playzone Partner Staff.

Playzone Partner shall address and resolve all User/customer complaints received by Pikniplanet relating to the safety, hygiene, or any other issues relating to the Services or behavior of Playzone Partner Staff at the center. Pikniplanet will not be responsible or liable to address any such complaints received from the users.

PARTNERSHIP TERMINATION

Pikniplanet reserves the right to terminate/cancel the partnership, at any time without assigning any reason thereof and in such case Pikniplanet settles all the financial with the partner within 60 days.

Pikniplanet determines, in its sole discretion, that the Playzone Partner has violated or is violating any applicable laws; and/or is in breach of any terms.

Pikniplanet Partner cannot terminate/cancel the partnership without intimating to the Pikniplanet Pvt Ltd. Playzone partner can terminate the partnership by intimating and providing reasons to Pikniplanet with a notice of 60 days.

CODE OF CONDUCT

Playzone Partner and the Playzone Partner Staff must be polite towards the customers and accompanying Parents or guardians, or any third-party present at the center.

Playzone partner should follow timings for all slots.

Playzone partner should provide basic facilities at the center such as rest rooms, sitting chairs etc.

FIRE SAFETY GUIDELINES

Playzone Partner shall ensure that the firefighting equipment including fire extinguisher is kept at the designated location at the center. Playzone Partner shall ensure at least one of the Playzone Partner Staff is trained to handle the firefighting equipment.

INTELLECTUAL PROPERTY

CONFIDENTIALITY

INDEMNITY:

a. The playzone Partner agrees to indemnify and hold PikniPlanet (and its directors, officers, agents, representatives, and employees) harmless from and against any and all claims, suits, liabilities, judgments, losses, and damages arising out of or in connection with any claim or suit or demand:

by the customers, for reasons not attributable to PikniPlanet;
in respect of, arising out of, or in connection with the Services provided by the Playzone Partner at the Center;
in respect of the warranties provided by the Playzone Partner under these Terms;
in respect of breach of the Terms by the Playzone Partner;
relating to harm caused by the Playzone Partner providing unsafe and
for any misleading or incorrect or false, information or data provided by the Playzone Partner.

b. The Playzone Partner acknowledges that PikniPlanet shall not be liable for any applicable taxes liability in respect of transactions by which the Playzone Partner provides Services at the Center to the Customers and the Playzone Partner hereby indemnifies PikniPlanet against any applicable taxes it may become liable for arising out of such transactions.

MISCELLANEOUS

No assignment: The Playzone partner must not assign, transfer, charge or otherwise encumber, create any trust over or deal in any manner with this partnership or any right, benefit or interest under it, nor transfer, novate or sub-contract any of Playzone Partner obligations under the partnership read along with these Terms
